Terms & Conditions for Photography Services
A non-refundable deposit of 20% is payable upon booking. The remaining balance is due within one week of receiving the final invoice. Cash or direct debit will be the only accepted forms of payment.
If the Client needs to reschedule their session, Empowered Imagery will accommodate the change only if the new date does not conflict with existing bookings. The priority for rescheduling will be based on the availability of the photographer.
The Client may not downsize to a smaller package after they have paid a deposit for that package. However, they may upgrade to a larger package at any time provided that Empowered Imagery is available for the upgraded package on the desired date and can accommodate the additional workload.
Empowered Imagery will be the exclusive professional photographer. Friends and family are permitted to operate cameras on the condition that they do not interfere with or get in the way of the professional coverage.
The Client and its agent’s, family members and assignees, if any, shall indemnify, and hold harmless, Empowered Imagery and Jerrica Ryan from any and all claims for damages arising out of the performance of any of the services contemplated by this Agreement with the exception of intentional or illegal acts.
Empowered Imagery reserves the right to terminate this contract at any time for any reasonable cause, such as accident or ill health. In such an event, Empowered Imagery will make reasonable efforts to find a replacement photographer. If a suitable replacement cannot be found or if the Client prefers not to proceed with a replacement, all monies paid up to that point will be refunded in full.
In the event of an emergency, equipment failure, or other unforeseen circumstances, Empowered Imagery will return any payments made up to that point but will not assume any further liability.
Empowered Imagery will not be held liable for any production issues beyond their control, including but not limited to bad weather, accidents, poor lighting, interference from external parties, or other unforeseen circumstances.
Empowered Imagery is not responsible for any missing, damaged or altered clothing or material belonging to the Client. Please be aware that due to the movement-based nature of the prompts suggested during the shoot, the client should anticipate shifts in their appearance and they may get dirty. It is ultimately the Client’s responsibility to make sure their overall appearance is the way they want for the photos. Empowered Imagery is not liable for any issues related to the Client’s physical appearance as their responsibility is limited to directing and photographing the Client.
Deliverable items are contingent upon the Client’s actions. Empowered Imagery is not liable for any compromise in agreed-upon items due to the Client’s neglect. The photographer is not responsible for photographs not taken due to the Client’s failure to provide reasonable assistance or cooperation.
The Client is obtaining photos for personal use only and shall not sell said photos. The Client is permitted to share photos with vendors having their products or setups photographed, provided that the vendors credit Empowered Imagery for any photos posted online. No commercial use is granted by the issuance of print or digital photos without explicit written permission from Empowered Imagery.
By choosing Empowered Imagery, the Client acknowledges and accepts the style of shooting, editing, and colour choices used by the photographer. The Client agrees to allow Empowered Imagery full discretion in making all final decisions regarding these creative aspects.
Basic retouching includes editing colours and removing obvious blemishes. Basic retouching does not include changes such as altering body shapes, fixing clothing or makeup issues, removing people or objects from a photo, or adding elements to a photo.
All outtakes and unedited photos are the property of Empowered Imagery. Clients may choose to purchase the unedited photographs from the shoot for an additional $1000 however, the Client agrees that all unedited photos are not permitted to be shared, distributed or posted under any circumstances. Only retouched photos will be released.
If the Client requests any additional editing beyond the agreed upon scope of work, including but not limited to advanced retouching or editing extra photos, a fee of $50 per hour of editing will apply.
CD/DVD’s are not available through Empowered Imagery. All files will ordinarily be sent digitally through an online photo gallery.
Upon taking possession of the finished product, the Client must inform Empowered Imagery of any technical or other problems with the photos within 7 days. After 7 days, if no notification has been received, the Client will be deemed satisfied with the product.
If the Client is not satisfied with their photos, they may be eligible for a partial refund of 50% of the total package price if the issue stems on the photographer’s end. Empowered Imagery is granted 1 attempt to re-edit the photos to the Client’s satisfaction. A partial refund will be considered only if the photographer has attempted and failed to resolve the issue and determines that a refund is appropriate.
If the Client requests a re-shoot of their photos for any reason, it will be treated as a new session, and the Client will be required to purchase a new package.
To maintain organization and conserve space, photos may be deleted or become unavailable 90 days after the Client’s session has taken place. The Client agrees to waive any and all claims against Empowered Imagery for the unavailability of such photos after this period, even if replacement is sought at the Client’s own expense. Therefore, it is strongly advised that the Client back up their photos to multiple storage locations to prevent any potential loss.
By booking, the parties agree that they fully understand and will be bound only by the terms above. Any other terms must be agreed to in writing. Otherwise, the above terms will be considered the consolidated, exclusive terms between the parties.
Terms & Conditions for Makeup Services
By booking with Empowered Imagery and paying a deposit, the Client confirms they have read, understood, and agree to all the terms and conditions, and accept their responsibilities as outlined below.
All service prices are subject to change without notice. Quotes provided by Empowered Imagery are valid for 30 days. To secure the quoted price, a deposit must be paid at the time of booking. If a quote expires, a new quote reflecting any changes or updated pricing will be required.

If the Client needs to reschedule their makeup booking, Empowered Imagery will accommodate the change only if the new date or time does not conflict with existing bookings. The priority for rescheduling will be based on the availability of the makeup artist. In the event that Empowered Imagery is not available on the new date, the Client agrees to forfeit any money paid up until that point.
For group bookings once the deposit has been paid and the date has been secured, the Client cannot reduce the number of people receiving makeup services. If the Client chooses to reduce the number of people receiving makeup services, they will still be responsible for paying the original price quoted for the full number of services initially booked. This policy is in place to cover the costs associated with reserving the date, including the potential loss of other Clients who may have been turned away.
For group bookings the Client may increase the number of people requiring makeup, subject to the Empowered Imagery’s availability. Any additional fees associated with increasing the number of people, will be based on the current rates at the time of the change and will be the responsibility of the Client.
Any changes to the booking, including but not limited to adjustments in timing, location, or the addition of applications, must be communicated as soon as possible. This allows adequate time for Empowered Imagery to make the necessary adjustments and accommodate the changes, subject to availability and any additional costs that may apply.
Cancellations must be made at least 30 days prior to the scheduled date to avoid full payment liability. If the client cancels within 30 days of the scheduled date, the deposit is non-refundable, and the full balance is due.
Empowered Imagery reserves the right to terminate a booking at any time for reasonable cause, including but not limited to accident or ill health. In the event of such termination, Empowered Imagery will make reasonable efforts to find a suitable replacement artist. If a replacement cannot be found, or if the Client chooses not to proceed with a replacement, all monies paid up to that point will be refunded in full, excluding any payment made for a trial if that service has already been provided.
If the booking is directly affected by circumstances beyond the control of the Makeup Artist, including but not limited to extreme weather conditions, natural disasters, pandemics, or safety concerns, Empowered Imagery will not provide any compensation. Empowered Imagery is not liable for any failure to perform its obligations under this contract due to events beyond its control.
To ensure Empowered Imagery can produce their highest quality of work, for all mobile bookings the Client is responsible for providing a location that includes the following:
A large table or bench space
Adequate natural light
Access to electricity/power outlets
A clean and safe area to work
Empowered Imagery requires 1 hour per makeup application. For group bookings, the makeup artist will also allocate up to 30 minutes at the end for touch ups. The makeup artist must stay within the scheduled time frame.
All individuals receiving makeup services must be present at their scheduled appointment times to avoid disruptions. For appointments involving multiple makeup applications, all services must be performed at the same location and consecutively to ensure a smooth process. Should there be any need for adjustments to the booking or timing after the appointment has been confirmed, Empowered Imagery will make reasonable efforts to accommodate such requests, subject to availability and any additional costs that may apply.
The Client is required to arrive with a clean, makeup-free face to maximize the appointment time and avoid incurring additional charges.
Empowered Imagery is not responsible for any delays to the finish time caused by the Client's late arrival or difficulty in following instructions.
If the Client or any members of the party are more than 15 minutes late to their scheduled appointment, Empowered Imagery reserves the right to cancel the service for that individual. However, the Client will still be responsible for full payment of the cancelled service, as the time was reserved for them.
Failure to attend your appointment time will result in forfeiture of your booking and deposit. The Client will still be responsible for full payment of the service, as the time was reserved for them.
For mobile services, a travel fee will be quoted upon booking. Any changes to the agreed location may incur additional charges. The Client is responsible for covering travel-related expenses, which may include but are not limited to transportation, airfare, accommodation, parking etc.
If there is no free parking at the venue, parking or valet parking fees must be paid for by the Client.
An early start fee of $50 will apply for appointments scheduled to begin earlier than 5:00 AM.
The Client grants permission for Empowered Imagery to take photographs and/or videos before, during, and after the makeup application process, as well as of the final makeup look. These images and videos may be used for marketing and portfolio purposes, including but not limited to posting on social media platforms, websites, and other promotional materials. If the Client does not consent to having their images or videos taken, they must notify the makeup artist prior to the service, and their preference will be respected.
Empowered Imagery adheres to stringent hygiene and sanitation standards, ensuring that all tools and makeup products are sanitized between applications. However, Empowered Imagery cannot guarantee the complete absence of allergens or irritants in products used. It is the Client’s responsibility to inform the makeup artist of any known skin conditions, allergies, or sensitivities prior to the appointment. The Client agrees to release Empowered Imagery, its owner Jerrica Ryan, and any associated employees or representatives from any liability for skin reactions or complications. The Client will not hold Empowered Imagery or its associates liable and agrees to indemnify Empowered Imagery for any harm, claims, or damages arising from the artist’s services or any related issues.
Empowered Imagery reserves the right to refuse service to the Client or any members of their party for reasons including, but not limited to, the presence of contagious conditions, such as cold/flu like symptoms, conjunctivitis, or cold sores, as well as any abusive or threatening behaviour. In the event that service is refused due to health or safety concerns, any fees paid up to that point will be forfeited, and no partial services will be provided.
